MEMORANDUM IN SUPPORT OF LEGISLATION
submitted in accordance with Assembly Rule III, Sec 1(f)   BILL NUMBER: A6962A SPONSOR: Joyner
  TITLE OF BILL: An act to amend the public health law, in relation to the establishment of obstetric hemorrhage protocols   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to improve birth outcomes and patient care for expecting mothers through the adoption and use of protocols and management strategies by hospitals.   SUMMARY OF SPECIFIC PROVISIONS: This bill would direct the Commissioner of Health in conjunction with clinical experts to develop or identify management protocols and strate- gies related to obstetric hemorrhages to be utilized by hospitals. Hospitals would be directed to adopt, implement, and regularly update their protocols related to obstetric hemorrhages, including a response plan for emergency transfers to facilities that can provide a higher level of care. The Commissioner of Health would be directed to produce a biannual report to the Legislature on the protocols and strategies developed and implemented by this bill.   JUSTIFICATION: In recent years New York has experienced a steady increase in the number of maternal deaths. Clear racial disparities can be seen in the underly- ing data showing a disproportionately large impact on women in minority communities. This bill will begin to address this mounting crisis by having the Department of Health work to create and make available stand- ards and tools for preventing and reducing the number of complications that may arise during a pregnancy or delivery. Making sure our hospitals have access to the appropriate tools will help to ensure that the grow- ing number of negative birth outcomes is stopped and eventually reversed. This bill will also help to State to become a more effective partner in combating the increasing number of maternal deaths and other negative birth outcomes. The information gathered under this legislation will aid in properly informing future discussions and activities by the state in addressing these pressing issues.   PRIOR LEGISLATIVE HISTORY: New Legislation.   FISCAL IMPLICATIONS: Minimal fiscal impact to the State.   EFFECTIVE DATE: Six months succeeding enactment.

JOYNER, GOTTFRIED -- read once and referred to the Committee on Health -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the public health law, in relation to the establishment of obstetric hemorrhage protocols The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 2803-n of the public health law is 2 amended by adding a new paragraph (c) to read as follows: 3 (c) (i) The commissioner shall provide guidance to hospitals on 4 obstetric hemorrhage protocols, in consultation with clinical experts, 5 and develop or identify an existing toolkit on obstetric hemorrhage 6 management, which may include a hemorrhage care checklist for use by 7 hospitals as part of the protocols and guidance on simulation training. 8 The commissioner shall report to the temporary president of the senate 9 and the speaker of the assembly on data reported to the department under 10 this paragraph within two years from the effective date of this para- 11 graph, and every two years thereafter. 12 (ii) The hospital shall adopt, implement, periodically update and 13 submit to the department standard protocols for management of obstetric 14 hemorrhage. Such protocols shall address early recognition and assess- 15 ment, readiness to respond in a multidisciplinary manner, and data 16 reporting to the department sufficient for the department to monitor and 17 report pursuant to this paragraph. Such protocols shall utilize risk 18 assessment tools such as the toolkit established or identified by the 19 department under this paragraph and shall include a response plan 20 providing for the triage and transfer to higher level facilities if 21 needed. 22 § 2. This act shall take effect six months after it shall have become 23 a law. Effective immediately, the commissioner of health shall make 24 regulations and take other actions reasonably necessary to implement 25 this act on that date.
