  TITLE OF BILL: An act to amend the general business law, in relation to requiring domestic violence and sexual assault awareness education for persons engaged in the practice of nail specialty, waxing, natural hair styling, esthetics and cosmetology   PURPOSE OR GENERAL IDEA OF BILL: To provide technical amendments to Chapter 715 of the Laws of 2019.   SUMMARY OF PROVISIONS: This bill would authorize the Department of State to consult with both domestic abuse prevention advocacy and sexual assault awareness advocacy organizations.   JUSTIFICATION: This is a Chapter amendment as agreed on with the Executive as provided in Approval Message 62. This bill provides additional flexibility for the Department of State to gather input from additional advocacy groups.   PRIOR LEGISLATIVE HISTORY: New legislation.   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None.   EFFECTIVE DATE: This act shall take effect on the same date and in the same manner as chapter 715 of the laws of 2019. The original Chapter was signed into law on 12/20/2019 and takes effect on 6/17/2020.

        AN ACT to amend the general  business  law,  in  relation  to  requiring
          domestic  violence  and sexual assault awareness education for persons
          engaged in the practice of nail specialty, waxing, natural hair  styl-
          ing, esthetics and cosmetology

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 408-b of the general business law, as  added  by  a
     2  chapter  of the laws of 2019, amending the general business law relating
     3  to requiring domestic violence and sexual  assault  awareness  education
     4  for  persons  engaged  in  the  practice  of the nail specialty, waxing,
     5  natural hair styling, esthetics and cosmetology, as proposed in legisla-
     6  tive bills numbers S. 6307 and A. 57, is amended to read as follows:
     7    § 408-b. Domestic violence and sexual assault awareness education. The
     8  department shall ensure that domestic violence and sexual assault aware-
     9  ness education courses are made available to all  licensees  and  appli-
    10  cants  for  a  license or renewal pursuant to this article and that such
    11  courses are offered through the department's website. The department, in
    12  consultation with the office for the prevention of domestic violence and
    13  [an] advocacy [group] groups recognized by  the  federal  department  of
    14  health  and  human  services or the federal department of justice, which
    15  [has] have the ability to coordinate statewide and with  local  communi-
    16  ties  on programming and educational materials related to the prevention
    17  and intervention of domestic violence or  sexual  assault  in  New  York
    18  state,  shall develop and provide access to domestic violence and sexual
    19  assault awareness education courses appropriate for those licensed under
    20  this article.
    21    § 2. This act shall take effect on the  same  date  and  in  the  same
    22  manner  as  a chapter of the laws of 2019, amending the general business
    23  law relating to requiring domestic violence and sexual assault awareness
    24  education for persons engaged in the practice of nail specialty, waxing,
    25  natural hair styling, esthetics and cosmetology, as proposed in legisla-
    26  tive bills numbers S. 6307 and A. 57, takes effect.
